Texas law change guide

The smoke shop shelf is gone. Here's what Texas left standing.

For seven years, hemp-derived THC was the workaround: delta-8 carts, THCA flower, strong gummies, all sold over the counter. Between March and July 2026, Texas dismantled the entire category, and possession of what you bought legally last year can now be charged as a felony. One legal path to THC remains, and it runs through a telehealth visit.

How the workaround died

  1. JUN 2025 Gov. Abbott vetoes SB 3, the total THC ban. Two special sessions follow; neither produces a hemp statute. The industry exhales, early.
  2. SEP 2025 The ban arrives by other means: SB 2024 bans hemp vapes, and Executive Order GA-56 orders TABC, DSHS, and DPS to regulate consumable hemp. 21+ age rules land within two weeks.
  3. MAR 31 2026 Smokable and inhalable hemp banned at retail. Texas moves to a total-THC standard: THCA now counts as THC, which kills THCA flower and pre-rolls, the biggest sellers in every smoke shop.
  4. JUL 31 2026 After the Texas Supreme Court clears the way, DSHS places delta-8, delta-10, THCP, and THCA on Schedule I. Possession goes from gray-area to chargeable as a state jail felony.
  5. NOV 2026 The signed federal hemp THC ban takes effect, closing the last loophole: low-dose hemp delta-9 edibles and drinks. After this, "hemp-derived" stops meaning anything on a Texas shelf.
Right now, today: hemp delta-9 edibles and beverages ≤0.3% THC remain legal for adults 21+ until December 11, 2026 — a month later than first scheduled, because the funding bill signed September 2 pushed the total-THC standard back from November 12. Everything inhalable, and every delta-8/THCA product in any form, is already a controlled substance in Texas regardless of what Congress does.

The legal path is not the one people assume

Most Texans who bought delta-8 assume the medical program is a bureaucratic maze: an application, a state fee, a plastic card, a months-long wait. That program does not exist. What Texas actually runs is the Compassionate Use Program: a physician evaluates you by video, enters a prescription into the state's CURT registry, and a licensed dispensary verifies you by name and date of birth. No card. No state fee. No application. The whole thing routinely happens inside a day.

And unlike the old smoke-shop products, what you get is regulated and consistent: gummies, tinctures, patches, and (since HB 46) vape products, capped at 10 mg THC per dose, from state-licensed dispensaries that deliver across Texas. The catch people miss: vape access requires the inhalation route written into your prescription, so ask for it during the evaluation — we walk through how the one remaining legal cart in Texas works separately. Smokable flower is the one thing the program flatly does not offer.

The gate is a qualifying condition. The quiet reality of the delta-8 exodus is that a large share of those customers were self-treating something: a back that never healed, arthritis, trauma that follows them to bed. Pain lasting more than 90 days qualifies, and so does PTSD. Evaluations run $45–$199, most services refund you if you are not approved, and our Texas guide compares every telehealth option.

Delta-8 ban FAQ

Is delta-8 really a felony in Texas now?

Since July 31, 2026, DSHS lists delta-8, delta-10, THCP, and THCA in Schedule I of the state drug schedules. Austin police have said possession can be charged as a state jail felony. How aggressively that gets enforced varies by county, but the legal exposure changed overnight from "gray area" to "controlled substance." Nothing here is legal advice. If you are facing a charge, talk to a defense attorney.

Can I still buy regular delta-9 gummies at the smoke shop?

For now. Hemp-derived delta-9 edibles and drinks at or under 0.3% THC by dry weight remain legal for adults 21+. That is the one shelf the 2026 rules left standing. The federal ban closes that loophole too, and the date moved: a funding bill signed on September 2, 2026 pushed the total-THC standard from November 12 to December 11, 2026. The November date still bites synthetics like delta-8, which Texas already made a felony in July, so December 11 is the one left on the calendar here. Treat the gummy shelf as a countdown, not a plan.

What if I order THCA flower online from another state?

Texas now measures legality by total THC: THCA counts as THC. Product that was compliant where it shipped from is still a controlled substance in your hands in Texas, and the package does not care that the website said "federally legal hemp." Where you bought it does not change what possessing it here means.

Does the medical program actually have vapes?

Yes. HB 46 authorized pulmonary inhalation, and licensed dispensaries sell vape products. Read the 10mg number carefully, because it trips people up: it caps a single dose, not the cartridge. The oil itself is unrestricted — typically 85 to 90% THC, about 425 to 450mg in a half-gram cart — so 10mg is a couple of pulls, not the whole thing. One catch worth knowing before your evaluation: the inhalation route has to be written into your prescription. Ask the physician to include it. Smokable flower is still prohibited; that part of the old smoke-shop experience does not exist in TCUP.

I used delta-8 recreationally. Can I just get a prescription instead?

TCUP requires a qualifying condition: it is a medical program, not a workaround. The honest good news: the list is broader than most people think. Chronic pain lasting more than 90 days qualifies, and so do PTSD, epilepsy, cancer, and others. If you were using delta-8 for a real problem (a bad back, old injuries, trauma symptoms), say that to the evaluating physician. If you genuinely have no qualifying condition, this program is not your path.

How fast can I switch over?

Faster than replacing a driver’s license. Telehealth evaluations run statewide, several services offer same-day video visits, there is no state application, no state fee, and no card. The physician enters the prescription into the CURT registry, often the same day, and dispensaries verify you by name and date of birth when you order.

Don't let your prescription lapse

Texas issues no card, so nothing expires in your wallet and no notice arrives in the mail. Access ends when your refills run out or your physician's follow-up date arrives, and most patients find out from a dispensary order that won't go through. Leave your email and we'll remind you before that happens, plus send the current renewal prices.
